Terms of Service
Welcome to Our Moment (“we,” “us,” or “Our Moment”). These Terms of Service (“Terms”) govern your access to and use of the Our Moment mobile application, website (if any), and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least the minimum age required in your jurisdiction to use the Service. If you are under the age of majority, you represent that you have permission from your parent or legal guardian.
2. Service Description
Our Moment provides AI-powered, template-based story video generation. Users can select templates and upload photos (and optionally text) to generate short videos. Our Moment focuses on warm, emotional scenes such as couples/family memories, pets, sleep comfort scenes, and gifting moments.
You acknowledge that:
The Service produces AI-generated outputs that may not always meet your expectations.
Output quality depends on uploaded media quality, lighting, angle, and template constraints.
Results may vary and are not guaranteed to be accurate, realistic, or consistent.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your device and account access. You agree not to misuse the Service or access it in unauthorized ways.
4. User Content and Rights
4.1 Your Content
“User Content” includes photos, images, videos, text, and any materials you upload or submit. You represent and warrant that:
You own or have obtained all necessary rights, permissions, and consents to upload and use the User Content;
You have permission from any individuals appearing in the User Content, where required by law (including for face-related processing);
Your User Content does not violate any laws or third-party rights.
4.2 License to Operate the Service
To provide the Service, you grant Our Moment a limited, worldwide, non-exclusive, royalty-free license to:
process, reproduce, modify, and transform your User Content;
generate outputs based on your User Content;
store and cache content temporarily to provide, maintain, and improve the Service.
This license is solely for operating the Service and ends when your content is deleted in accordance with our data retention practices, except where required for legal compliance or dispute resolution.
5. Prohibited Content and Conduct
You agree not to upload, generate, share, or use the Service for any content that is illegal, harmful, deceptive, or violates others’ rights.
This includes, but is not limited to:
Non-consensual content: creating content of a person without permission, including face-swaps used to impersonate or harass.
Sexual content or nudity, especially any content involving minors.
Harassment, hate, threats, or violence.
Fraud or impersonation, including pretending to be another individual or public figure.
Copyright infringement, including unauthorized use of copyrighted images or characters.
Defamatory content, misinformation or deceptive claims intended to harm others.
We may remove content, suspend access, or terminate accounts for violations.
6. Safety and Responsible Use
Our Moment is designed for entertainment and storytelling. You agree not to use outputs to:
mislead others about real identity or real-life events;
create deceptive “proof” of events that did not happen;
exploit sensitive scenarios in harmful ways.
We reserve the right to implement safety restrictions and to limit certain template usages.
7. Intellectual Property
The Service, templates, interface design, branding, and underlying technology are owned by Our Moment or its licensors and are protected by applicable laws. You may not copy, modify, distribute, or reverse engineer any part of the Service except where permitted by law.
8. Payments and Subscriptions
Certain features may require a paid subscription. Subscriptions are processed through Apple In-App Purchase and are subject to Apple’s terms and policies. See Subscription Terms for details.
9. Termination
We may suspend or terminate your access to the Service at any time if:
you violate these Terms;
you engage in abusive or fraudulent behavior;
we are required to do so by law.
You may stop using the Service at any time. Subscription cancellation must be completed via Apple subscription management settings.
10. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation.
11. Limitation of Liability
To the maximum extent permitted by law, Our Moment shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of your use of the Service.
12. Changes to These Terms
We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
